He's right... if it's not on the title, it's definitely not going to show up on CarFax.

You need to call the DMV in the state you live in and have them investigate the title. My guess is it's either a mistake or you have an older copy of the title that pre-dated the "salvage" one.

**EDIT -- I'll add to the whole "Carfax" piece of your question. Under Carfax's terms of use, it is against their policy to do what you're asking.

**EDIT 2 -- Ok, then I would contact an attorney. Although there is no "right of rescission" that applies to vehicle sales (in other words, you don't have a "3-day", "30-day", etc return policy to just take it back), if the title was indeed salvage and he did not disclose this to you... he's liable to take it back. You may have to go to small claims (the judge might say "you should've checked for sure beforehand, especially when you heard he hadn't issued a new one since 2005), but it's your only recourse at this point. Also, if the DMV finds that it is indeed a salvage title, ask them what recourse you may have that does not involve court. South Carolina may be different than other states in that regard. **Side note- I used to work with a "Sarra" in TX, she moved to SC. If you're the same person... small world.

You need to check with the lending institution that holds the mortgage. Most likely they will be happy to have someone else on the mortgage who has agreed to be responsible for payment.

However, getting on the mortgage does not give you any rights to the property. All it does is obligate you to pay the loan.

If you want to be listed as a part owner of the property, you need to get on the deed. For that yoiu need to check with the county clerk's office to find out the procedure for that. Since the lender has a lien on the property, they may will probably have to approve adding you to the deed.
