The title company is bound to the buyers, not the sellers (original title holders). The sellers had no contract with them and it is only the buyers that may collect on the title insurance.

There is a huge amount of paperwork involved in putting together a mortgage. The companies that have to work together all have different ways of doing business, and it's easy sometimes for paperwork to be misplaced or misinterpreted.

However, all of the companies are focused on one goal: to make the mortgage loan a profitable one for all involved for the life of the loan. It is unlikely that any one of the folks involved would risk committing fraud in such a high profile area as insurance.

Sounds like an honest mistake.

Each state has an insurance department, and each one of these has a fraud unit.

So you contact your state insurance department's fraud unit, and file the claim there.

There are two issues at play here:

EDITED: 1. Whose car is it? --Both (you said). If so, they are both responsible for whomever drives the car (unless it is stolen). Stepdad can't just discontinue insurance for one of the legal owners of the car, and then not take responsibility for it.

2. Who was driving? --Boyfriend. Boyfriend is responsible for damages caused when he is behind the wheel, UNLESS he is a minor (that's why people have insurance).

I your bf has a case against stepdad. But I'm not a lawyer -- consult one tomorrow!
