If he has a legal note stating the debt, he can probably enforce it. If he just loaned you money without any paperwork, he really can't enforce it IF you are not a minor. If you're still a minor, legally you win nothing, and he can withhold the vehicle all he wants.

If you're over 18, the car is yours. But remember, dad also has no obligation to EVER loan you a dime again.

On a New York title, a lien release is attached, which sounds like what you have, so the title is free of collateral. On the back side of the title, there are 2 reassignment boxes. You and the seller need to fill out the top part. There is only one place for him to sign and one place for you to sign.

If you DO need to send it back to him, send it certified or express mail so it can be tracked, and SIGN the title first so he can't take it and sell it to someone else.

I don't know what you mean by "signing for out of state vehicles." Are you talking about an application for title that the DMV needs? That can be sent to the seller alone; hang onto the title.

Also, get a bill of sale. The DMV will need it to prove how much you paid for it.

The car will be worth much less than a car like it with a normal title and you may have trouble getting someone to insure it. If you got enough for it, you may come out alright though.

The obvious answer is: You need to find out WHY the proof of insurance isn't being accepted. If you don't know what may be wrong, how can you fix it ? Contact the DMV and ask why.
