Yes, you can get title insurance on any property. Getting title insurance showing a clean title is something else.

If the tax lien was the only lien on the property when you bought it, then you have clean title. If all other liens were paid off as a result of the purchase or if the lender signed off, then you have no problem.

If there are other liens on the property or other owners of record, the title insurance will be issued "subject to" those people and lien holders. Therefore, you CAN get the title insurance, but it would be worthless to a new buyer and their lender. The sale will fall through.

You have 2 options:

Go to a good title company like First American Title Company and ask them to run a chain of title for you to make sure you have good unblemished title. Offer to pay for it.

Go to the Kern County Clerk and Recorder's Office and do it your self. Before you do that, make sure you know what the heck you are doing.

The title company will do a more thorough job for you and the peace of mind is worth it. If your plan is to sell the property and you promise the title order to them, they will cut you a break.

I think you should call them. I also think you are probably okay with the title, but there could be something lurking in the back ground. The information on your paperwork should clearly outline any outstanding lienholders, if any, on the property.

P.S. Visit the property. There are exclusions in title insurance for "parties in possession" and people who are adversely using the property as ingress and egress for accessing their own parcels of land, whether they have the right or not. Kern County is vast. Get a plat map from the City or County and know your lot lines and fencing issues if we are talking about acreages here. The title companies also don't insure anything a survey would have revealed.

You will need to give Power of Attorney to your friend, the form will state that it is only for the transaction of a vehicle title, give description and VIN, date, and be sure it is notorized. You will also need to make a written statement, also notorized, stating that you have lost the title, that you need the title expediated because of title/registration issues in California. It would be best if you sent her your registration, just to make things easier, having documentation regarding the car can't hurt. You can pick up a Power of Attorney form either through the DMV, or a stationary store.

They all do. But you as the buyer would have to allow them to "insure over" the bankruptcy issue. If anything bad came from the bankruptcy, you would not be covered. How brave are you. A bankruptcy judge can cancel any realty sale at any time. They do it all the time. But if the seller is honest and you trust her, you could take a chance. The seller will sign because she has nothing to lose.
The real answer is how much less is that house worth without clear title. Would the seller discount another $10,000 if you accept the "lesser" insurance. Would the seller discount $50,000? Now i'd get interested.

You have to turn them into the state. They do this to ensure that they won't end up on a stolen car or on another car you may own and don't want to pay the registration on. Plates are issued for a specific car.

You don't need to be on the title. You don't actually even need to be on their insurance, as long as you are a valid driver and have permission.

The mortgage problems have lenders shutting down programs almost daily. It has now gotten to the point that you must invest something into the property or you will not get a loan.

You can still obtain a FHA loan with a grant program. Some lenders may let you use the Nehemiah or Sovereign Grant Alliance program. The latter is government run so more plausible that it is still in use. With FHA you would be required to put down 3% or the grant would cover this and the closing costs provided the seller agrees to have the funds released from his proceeds. FHA will also allow gift funds from relatives or friends with proper documentation.

There are no more 100% programs available to date. The MI companies now refuse to cover this type of loan.

Yes closing cost can be rolled into the purchase price if the value is there to increase the sales price.
