Fill out everything you can on the duplicate application form and the DMV can look up the number in their database. The title number is on the title only.

Sad for sure, BUT there are 2 ways to look at it....

1st need to know what PAPERS she has with your name on them ???? This will be needed to tell you what rights you have.

"didnt require full coverage" Where was this stated ? Contract ? writen paper that you both signed ?
Bill of Sale pending payment ?
Payment booklet ? With your name on it ?
A police report for the Wreck that totaled the car ?

These tell all.... No one can give you the right answer without them.

From your words not mine:::: If she didn't request FULL coverage on the car at the time you left with it after down payment and you have proof of statement it falls on her if the car is in her name... If the car has another party as Orginal Lien holder ((EXAMPLE GMAC, Bankof America etc...))
Then she is Lible for full payment and she was to have Full coverage while under payment contract... ALSO if she has a lien holder that she was paying she might have been doing a little fraud selling the car to a 3rd party without letting the Lender know there was someone else now in the picture.

NO one is Stupid enough to BUY a Car on Credit and not have Full coverage insurance ???? ....Yes people do it every day. 38% of people driving next to you down the street or on the highway, NONE of the 38% can afford insurance so they don't by it. (your state might average mor eor less)

Comes back to paper work on the car that you have THAT you signed that she has copies of.... Of that you signed and ONLY she has copies of....

Hire a Lawyer....

Only way you have out of this is if SHE doesn't have in writing with your signature on a Bill of Sale pendening payment and/or Statement declaring you to carry full coverage insurance....

....If you Finance a Car GET insurance to cover the car . Because (as you've learned NOW) things happen....

Affidavit of Nonuse in Lieu of Liability Insurance
You can find this form at:

On the form you must list the range of dates that the vehicle will not be driven and why. The form must be notorized.

Assuming you do not have have a loan on the car and you have clear title you can do whatever you want with the money. You can deposit the check and then pay the body shop with your own check. You can keep any extra money. It is not fraud to do so. I see it all the time and it's not a problem.

not too much of a problem , motor vehicles in B.C. will be able to find out the vehicle was last registered in Alta. and with a copy of your death certificate there will be no problems if it was jointly registered, do you still have a copy of the pink slip ? do you recall the address of where you resided when it was last insured / registered ? in cases like this the bureaucracy actually does have compassion . sorry to hear about your loss
