Think about being a LANDLORD-you have to overseer the property OBOY are you up to this-people can be destructive-will your home depreciate if you get a bad tenant and you need to know the renting laws and contracts-your insurance probably goes up, you will still have taxes, repairs,mortgage's and plus a new although small rent. You will pay taxes on rental income earned. Not sure about your loan. Would the new tenants mow their own lawn, and remove snow,and fix the plumbing and sticky doors? If you sold then your paid up equity could generate INCOME even in simple CD's. Houses my go down further at a later date. Small rents don't need insurance as houses.Good luck.

find work closer to you --2 hours each way kills a good day. you "only " work 8 hours,

go to court and seek a judge who will judge in your favor to sell the house if that is what
you want to do. Why a divorce is not applicable to you amazes me.......maybe your
creed/religion/heritage or pride is in the way.

Wow, I'm sorry for your hard times. When it rains, it pours, huh? Anyways, I'm sure you know that a.r.m. mortgages are bad news. I hate to encourage people to file bankruptcy and include their homes in it as well. But, in your situation, I would have to say yes to include it. If you are struggling to pay the bills now, what is gonna happen when your mortgage doubles? As long as you can afford to rent. Depending on where you live, sometimes renting is just as expensive if not more than owning. Do you have a lawyer that is going to handle your bankruptcy? If so, talk to him/her about your concerns. Don't just take the Yahoo answerers word for it, get some legal advice as well. Good luck and I hope things look up.

Easy answer...

YOU have insurance, right? File a claim with them first.. let them take care of your problem and then they will deal with the upstairs tenant.

As an alternate, you can also send a demand letter to the tenant AND to the association listing all of the costs and damages and demanding payment. If you are not paid or a receive a blow-off letter then you simplty take the matter to small claims court.. assuming that the total is under $5k or whatever CT law max is. (But in almost all states you must make a written demand first)

either way your problem will be solved.. one just takes longer then the other.

Joint tenants own property equally. Go in yourself and see what is going on.

With joint tenancy, both have to sign documents to sell. It he won't sign, you are SOL.

Wait until no one is home and torch the place and collect your 1/2 of the $$ that way.
