You will have to go to probate court and have the ownership legally transfered over to your mother and any other heirs. Your mom is not committing a crime, but she should have the property probated.

There might be some IRS penalties because all estate taxes are suppost to be paid within one year after the death of the property owner. You will need the help of a probate attorney to get this sorted out.

If your mom has brothers and sisters they would also have a legal claim in the probate proceedings.
