Sound advice? Hire a lawyer and defend. The trespasser did not issue a warrant and cannot press charges. That court issues warrants and only the prosecutor can decide to press charges. The person probably gave a different version of the events to the cops and that is what led the court to issue the warrant. If it is proved that father pointed a gun at a trespasser, he might well have trouble, but there are all sorts of nuances such as the right to use reasonable force to eject a trespasser and the defense of property. Each of those is different in every state and country. In addition, the question of whether the guy was indeed trespassing varies by location. In my state, you (but not Dad) can exclude someone only be giving that specific person notice to stay off the land. That is not true everywhere. Get a lawyer to defend this action and to take other steps to protect yourself and your property and to ensure a fair property division. You cannot do this effectively on your own.

Yes a "short sale" is a bad thing on your credit. You did not pay as agreed.

It is better than a foreclosure for a number of reasons (less legal costs is a big one).

If you have money the mortgage company will very likely not agree to a short sale and require you use your money to pay the shortage at the time of sale. (They would not have had a share in any gain and do not feel they have to have a share in any loss- they don't own the house, they just loaned you the money to buy it)

You need to get this attorney's letter over to your bankruptcy attorney. The must have petitioned the court and convinced the judge to remove the house from the BK proceedings. You need to get it added back in.

Yes, the foreclosure will tank your credit.l Having both the foreclosure and BK ius a double whammy.

your friend made a stupid decision. we ARE paying as now that lender (like so many others) is getting back only a small portion of what was given out. look at the companies on TV saying - i can get your debt down to 65%..... who's going to pay the other 35%!? the lender will be taking a loss -- someone has to pay. I like your idea of the 50 year loan - sadly they are not doing that. realtors and brokers are TELLING people who CAN pay their mortgages - don' t pay so you can get a short sale and just get out.
