Trial lawyers are the largest special interest group donating to political parties and candiates.

They give more than the next 20 largest special interest groups combined.

IE: more than big oil, insurance, pharmacutical, realestate, etc combined.

80% of thier donations, go to the DNC and democratic candiates.

So of course Obama is NOT going to do anything about the high cost of malpractice insurance.

He is a lawyer, he knows where his bread is buttered.

i think your 6th point would be a good incentive to doctors. for the 5th, how would the tier system differ for those who are uninsured? 7th- would the exclusiveness motivate the companies to sell cheaper, or to jack up the prices? with no competition, it tends to raise the price.

My opinion - the EASIEST, FASTEST solution would be making punititve damage awards EXEMPT from attorny contingencies.

Doctors don't HAVE to be at fault, especially obstetritions. From PERSONAL experience with med mal claims, the nightmare is always a DEAD BABY. Juries ALWAYS find against the doctor with a dead baby, REGARDLESS of fault. Insurance companies don't even try to fight those claims, they just offer out the policy limits, because a jury will ALWAYS side against the doctor.

The bottom line:

Health Care is a human right that no person should be denied (in my opinion even illegal immigrants) and to do so is a sin and a crime.

I believe that there should be national/universal health care. The government should pay for it just like public education. The government would never deny any child the right to go to school...shouldn't health care be the same way?

No. Many states have implemented tort reform. California has had it for over 10 years. There are no big malpractice awards, yet no one has ever had their insurance rates go down, and malpractice insurance costs just as much there as anywhere else..

I guess they somehow think that taking away our right to sue for damage caused by incompetence or negligence is a good thing. Funny how Republicans are OK with taking away rights when it suits their agenda, and their followers are with them. Don't they realize that someday they may be in the position of being crippled for life my a bad doctor?

If you value your rights, don't take rights away from others.
