What happens with joint checking accounts if one person dies?We Answered:
The owners of a joint checking account each have access to all of the funds in that account. On the death of one of the holders, the account reverts to the other account holder. Whether or not a debt would be chargeable to the account would depend on the relationship of the holders to one another. For instance, if the holders are married to one another in a community property state, then the debts incurred during the marriage, no matter who incurred them, would be payable from the account because the debt would be considered to be joint. I am not sure what the case would be if the parties had some other relationship to one another, but believe in that case that one-half of the money in the account would be considered to belong to the estate of the deceased and thus used to help settle the debt. In any case, if the estate of the deceased is not of enough value to settle the debt, then a survivor who is not part of a marriage in a community property state is not responsible for the rest of the debt. For example, if you hold a joint account with a parent who dies and there is only $5,000 available to settle the $30,000 debt, then the debt-holder is just out the rest of the money. Lenders will consider a loan modification if there is a legitimate hardship and, as in your case, a reduction of income is a legitimate reason. Other reasons are unexpected medical/dental cost, unavoidable increase in expenses, job loss, divorce, death, etc. Typically, when lenders modify a loan, they try to reduce your mortgage payment (PITI) so that it equals about 31% of your gross income. Before your financial situation worsens, call your lender, tell them that you want them to conider you for a loan modification and ask them what documents they'll need from you (usually paystubs, bank statements, tax returns and an income and expense sheet) to consider you for a modification. Once you gather all required documents, send it to them and follow up with them at least once a week. Most importantly, if you are dealing with the lender yourself, be PERSISTENT!!!
