You did not say if it is an easement that YOU own and someone else uses, or if someone else owns it and YOU have the easement, but the first stop there is the easement document to see if it deals with maint. and responsibility. If not then the owner of the land where the trees stood will likely have the responsibility. If that is you then include it with the claim. If it is not, then have your company contact the owner for his share of the damages.

It is not illegal, but not a customary request on residential property (somewhat common in certain commercial leases). The first mistake was signing the revised lease after the original lease was signed. If the original lease was canceled and the revised lease was signed "the husband" is liable to pay the property taxes and the homeowners insurance outside of the monthly rent. This is a prime example why anyone entering into an agreement should fully understand the contract before signing.

Likely the premiums for everyone in the area will go up. Most of the time, a hail storm like that is a 'catastrophic' claim, and the insurance company isn't allowed to surcharge you, for a cat claim. It also can't "count against" you when it comes time to tally up all your claims.

It does, however, make you lose any loss free discount you might have had.


You can ask your agent to be double sure.

Well, is she waiting until the roof rots away completely and collapses, or is she going to put a new roof on?

"Winter weather" doesn't make roofs leak. Winter weather is called, "Normal wear and tear". If it's time for a new roof, it's time for a new roof. The insurance company only pays for sudden and accidental damage, like a tree blowing down on your roof, or hail damage, or collapse caused by weight of ice and snow (if there's no rot underneath), or ice dams. But it's up to HER to maintain the roof.

Most of the time, her rates WILL go up if she files a claim. But if they don't pay because it's a maintenace issue, not only will they not pay, but, they'll require her to fix/replace the roof.

My recommendation is to call your auto insurance agent and let them find a few quotes for you. If your Auto agent can't help you they should be able to find someone who can.
