You may want to sue the person for the difference in rates if this happens as it would not have happened if not for their negligence.

If your car is written off, the policy ceases there and then. It's because that policy covered that car, which is no more. When you find a new car, it will require a new proposal & your premium will depend on that.

No. Insurance is a service, it's not a loan.

The only things that show up on your credit history involve lending you money and you paying it back (e.g. credit cards, car loans, mortgages, personal loans, etc.). This is the same reason that cell phones, water bills, and rent don't build credit.
