As soon as you change coverage it goes into effect right away unless of course you specifically asked for it to be updated the following month. Any and all unused premium from the current month would be prorated and reimbursed to you.

It means that when they originally rated the premium they rated it for a long term. Now because you are cancelling, they may , but not necessarily will, re-rate it for a more expensive, shorter term and if they do, you may owe an additional amount.

Legally, your carrier is abrogated to your right of recovery. As you may know, this is just for the amount that they pay. However, your carrier has as much right to _anything_ paid by the other person as you do. So if you collected anything from the other person, your carrier would legally be entitled to at least a portion of it.

You could let your carrier seek recovery of the amount they are owed and usually this would include asking for your deductible but seldom will they ask for your rental payment. Also, it's unlikely that they will collect much of anything.

With that said, about your only recourse is to file in small claims court. This will get you a peice of paper called a judgement. It's not money... it's just a judgment. Still no guarentees you will be able to collect. If you could/do... I'd say keep it and let you carrier find out on their own if they can. That is just my opinion.

My other recommendation is to make sure the police or at least the state knows that this person is uninsured (if GEICO confirms this). That way the state can suspend the person's drivers license until they pay you what she owes. If the state does not find out, she will continue to drive and cause someone else the same loss you suffered.

You may need something like a car or your home to borrow against, I'm not sure. I do know that when I had surgery my bank let me skip mortgage payments for 3 months and they were just added to the end of the loan. It's needed surgery, I'm sure they will work with you. Good Luck

Just get a quote from insurers you get from yellow pages,. the internet, the TV, the radio.
Simply don't go for the first price they quote you but spend a few days collecting data.

Since you were in violation of your policy and your claim denied because of this, you really don't have any options with regards to your insurance. Have you thought about going after the excluded driver. Does he have coverage on another car that might extend to yours? You might have to sue the driver for the cost of the car.
