If your vehicle was parked by the curb (right side against the curb), it could not have been caused by another vehicle and it would be a comprehensive claim. If in a regular parking area, then yes - collision.

Sometimes deductibles are lower on comprehensive coverage.

Either way your deductible would apply, yet it should not affect your premium.

No,you technically did the right thing, mitigated your damage(s), and found a replacement vehicle. By the way, THIS you are required to do by law. They don't owe you anything else other than payment for your damages to your car.

As for the t/l process....you would think it was a piece of cake wouldn't you? You think your insurance company is dragging their feet? Ya, that's what their doing. State law has nothing to do with it, DMV regs have nothing to do with it. Phone calls, mail, the 100 other claims they have to deal with have nothing to do with it. You'll get your money when state law has been satisified--all it takes is the DMV rejecting the title work on your car and there's a HUGE delay right there.

Yes, they can file a claim and claim you did damage to their car and they now have whip lash. You should have told the police they were refusing to give you their information and it could have been dealt with at the time.

All you can do now is file with your insurance so they will be ready when the other person tries to scam you for bunches of money. If the police were there, even if they didn't do a formal report there should be something on the log about it. As I said, report it to your insurance with all the information you have, and hope they will do the right thing. Hopefully you did get the license number and make and model of the car you hit.

Unless you are driving an '85 Toyota, that's not enough damage to warrant totaling it. Nor is it the type of damage that when properly repaired will materially affect the value of the vehicle.

You can sue if you wish but it won't go anywhere. If you don't win it's entirely likely that you'll be stuck with the other party's attorney's bills on top of your own. The way that attorneys charge that's probably more than the cost to repair the damage was in the first place.

This does not sound like a good deal. $30 per day is $915 per month, on average. If you can afford that for something that just covers accidents, you can afford real health insurance, which is not much more and also covers illness.
