Most of the long-term agents I've known in the busines did NOT pass it the first time. What really matters is, can you sell? ANYONE can get a license, if they work at it enough, but NOT everyone can sell.

Locate the policy and read through it. If you believe that he was tricked you can consult with an attorney. This might be difficult to prove without witnesses to his insurance purchase other than the agent.

We Answered:

Where are you from. There are different regulations depending on where you are and what kind of insurance you will se. For Life and Accident and Sickness, in Alberta Canada, you have to write a pre-exam, pass that, then write the provincial exam and pass that. Each test is about 4 hours long. Once you have passed, you need to get a company that is licensed to sell in Alberta and have them sign for you as an agent. Once the paperwork is submitted, fees paid and approved you get your license. Then you have to get continuing education credits every year to keep your license.

He could not have taken a policy out on you without your knowledge. You had to sign the application and been processed, if he is beneficiary and you as policy owner. If you want, trash the original and get a family plan that covers the main breadwinner, that person's spouse and all children both present and future, ALL on one policy. Think more along the lines of term insurance and set up a retirement account.

The policy will supercede anything you do including the post-nup.

Life insurance is very possible. He would have to pay a little extra than most other people, but it shouldn't be too bad. A person in his situation would probably do well to keep checking on insurance rates every few years or so to see if he could get a better deal from another insurer.

"Accident" insurance or disability insurance (something that would pay him an income if he got sick or hurt) would be more of a challenge. Broken bones and deteriorating joints is more likely than death. He would probably have to find an insurer that specialized in higher risks (like Assurant, The Standard, or even Lloyds). He may be required to get a policy with a long elimination period (the time you wait before the policy pays out) of six months or more.

But that's just one opinion of someone who's seen this type of situation. For all I know there may be an even better deal out there because no single agent can know all insurance companies.

Your question is a little confusing. If you are referring to one life insurance policy and one medical policy, the answer is yes only if the person had medical expenses (paid for by the medical policy) and then died (paid for by the life insurance policy).

If you have two medical policies, then usually only one will pay. It is possible that the second policy may pay for any excess medical charges that the first policy does not pay for but the second policy will not give you money for the medical bills that were paid for by the first policy.

If you have two life insurance policies, then both will pay if the person dies.

If you have a benefits policy and a medical policy, then usually both pay. For example, the benefits policy may pay you a certain amount of money for each day your are in the hospital and the medical policy will pay for the medical bills.
