Depends - you'll get your deductible back only if it was determined that you were not at fault in any way. Your insurance company should have gone after the other person's insurance company for collection of the your deductible. If they didn't do that, then you are not getting your deductible back. That's what a deductible is.

You are asking two different questions. First off you cannot insure an unlicensed driver anywhere. It is a condition of any insurance policy that only licensed drivers operate the vehicle. It is asked on any auto insurance applications whether any driver listed on the policy has their license suspended, revoked or if it is invalid. I take it the other driver was unlicensed, however being unlicensed does not make them automatically at-fault in an accident. This is more an issue between the owner of the other vehicle and their insurer as their insurer would probably try and get out of paying the claim since an unlicensed driver was allowed to drive the vehicle.
For your second question, if Fred Loya your insurance company or their insurance company? Are they claiming contributory negligence on your part? What reason are they giving for the low payout?

They might pay - they frown upon family members not being covered so they may not pay. I would suggest getting your own policy before the investigation. You may want to try a website that compares multiple companies at once to get you the best price. I am paying less than ½ after I did.

Get the account number that the cheque was cashed from. It should be printed on the back of the cancelled cheque.

EDIT: Even if the cheque was cashed...there should be trail...either the person who cashed it had an account where it was cashed, or they would have had to present ID to confirm they had the right to cash it, unless your mom was foolish enough to have it made out to "cash" then she is SOL, I'm afraid.

Comprehensive coverage covers things like hail damage, broken windsheild...etc.

Collision damage would cover the impact damage to your car. Always, regardless of who is at fault, if you pay for collision coverage you are entitled to it.

So - even though you were in a hit and run - you mom's insurance could cover the damage - less the deductible.

If you were injured - some policies carry med pay coverage which would cover your medical expenses (no deductible) up to a certain limit.

You would also have a UM claim (uninsured motorist). Essentially, your insurance company would step in and pay the damages you would have been entitled to for your injuries as if they were the other driver's insurance company.
