Victoria Said:

What type of attorney do I need?

We Answered:

You could contact the salvation army and see if they could assist you in getting this vehicle back or providing another. They have tonsof resources available as does United Way and others.

You can post a question to this law webite (for free) and get up to 4 responses from attorneys in your area- go to www.lawguru.com

So sorry to hear this is happening, and so close to Christmas too.

Marshall Said:

Motorcycle accident - How much insurance money will I get?

We Answered:

Impossible to say and it will not even be assessable until you are almost over all the injuries. Even then expect it to take a couple of years to sort out and longer if they do not settle out of court.
As an agency worker with no guaranteed income you may get very little if anything for lost earnings but they should pay out on the pain and suffering you have sustained.
Remember any compensation recieved, in part or full, may have to be paid back to the Benefits Agency if you have been able to claim from them.

A specialist solicitor is the one you should be asking.

Natalie Said:

A person's dog caused a motorcycle accident, what is the owner's liability?

We Answered:

You can file a claim against the dog owners homeowners insurance. Depending of the language in their policy- they may have coverage.

Your insurance company will pursue the lady for the damage to your motorcycle. The process is called subrogation.

Did you have to seek medical treatment for your minor road rash? If not, just let it go. Pat yourself on the back for using the proper equipment and being a heads up driver. Too many times in today's something for nothing society we forget the golden rule : do unto others as you would have them do unto you. If I tripped on the lose step of your home and skinned my knee- I could seek compensation for my injuries - but really.

If your concern is that the dog is a hazard because it is allowed to run lose - contact the local animal control.

I'm glad to hear your injury was minor.

David Said:

Can a hospital/collection agency put a judgement against you for hospital bills?

We Answered:

First things first, never deal with a collection agency. Under the Fair Credit Reporting Act, you have a right not to be contacted by them. Send them a "cease and desist" letter, which basically says not to contact you about the debt:

"Under the FCRA I am charging you to cease and desist contacting me about this debt. I am currently paying $200 a month and that is all I can afford."

If you get a summons, don't ignore it. Hire a lawyer and he will negotiate with the court and tell them $200 is all you can afford to pay. If that doesn't work, threaten to file bankruptcy and that will stop them in their tracks. $200 a month is better than nothing.

Bottom line is, continue to pay what you can. DO NOT pay anymore than you can afford. If you have any problems, get a lawyer to defend you. But NEVER talk to them on the phone; do it in writing only.

Guy Said:

Who is at fault in my accident?

We Answered:

This same situation happened to one of my insureds. He was driving straight and a lady in a minivan on a cell phone pulled out in front of him. He laid his bike down to avoid hitting her and ended up totaling his bike. Unfortunately, because he failed to control his vehicle the claim was filed as a negligent accident. It doesn't seem fair however that's the rules of the game. Avoiding an accident and causing another will be filed as negligent. Since you never came into contact with the other party they are not liable for your vehicles damages.
