If a contractor can't or won't show you his license and insurance certificate, hire a different contractor. That is the first thing you should ask and the first thing he should do for you. If he can't do that, what else can't he do?

CA has some very weird rules and regs concerning what Corps can and cannot do but, generally, if the person you are paying holds him or herself out to do work for a third party that person becomes an 'independent contractor' and need not be on the payroll. Therefore, 1099's are acceptable. You should be able to find CA statutes applying to independent contractors and 'employees' very easily. Good Luck
