Key Insurance Agency

Sue Said:

After you file a claim with your insurance agency for vandalism, when do you pay your deductible?

We Answered:

Try to deal it out of pocket, otherwise insurance rates will go up much more. You can check how quotes will change here - autoinsurance.noneto.com

Matthew Said:

I have to go give a statement under oath to my insurance agency with their lawyer present. Do I need one?

We Answered:

See if you can make them provide you a lawyer at their expense. Insurers have two duties-- the duty to indemnify (pay a valid claim) and the duty to defend (provide you legal assistance if someone sues you.) They love taking your premium payments, but they hate complying with their duties and look for any way out. They know A LOT more about avoiding their duties under the contract than you-- they do it all the time, in fact, that's how they make money.

Here there seems to be a major conflict of interest brewing-- they're trying to get you to say something that would relieve them of their burden to indemnify you. Obviously they are entitled to the truth and to your cooperation, but they're walking briskly towards that line marking the boundary between good and bad faith.

Say you think they are acting in bad faith-- which is a tort in the insurance context. (I don't think they have breached the covenant of good faith and fair dealing [a sexy term they're sure to respond to if it use it] but it never hurts to show off a bit.)

Demand that they provide you a lawyer because of the conflict they're creating/exploiting. In CA they call it Cumis counsel (from a famous case.) See what happens. I bet they pay you.

Charlie Said:

Dealer still does not want to send me the 2nd key or compensate me to buy a new one?

We Answered:

Unless it was in writing on a 'We Owe' form, then it's your word against theirs. Always get things in writing because it will probably cost you more than $450 <total cost of a second key> to pursue action against the dealership to try make them give you one. Good luck and I hope this helps.

Sergio Said:

Will my auto insurance rates increase if I put a claim in for the theft of my keys?

We Answered:

Theft of keys would be a comprehensive claim - not a chargeable incident.
It's nothing like an at-fault accident.
