Insurance Agency Agreement

Guy Said:

A quick question with regards to Insurance agency agreements?

We Answered:

3

The principal has to pay HIS companies on accounts written - so, normally 15 days into the month after the policy was sold - on agency billed accounts.

If it were a "direct bill" policy - the agent should be required to pay when the application is submitted.

Good luck and I hope this helps!

When I rent a car online, I also purchase the insurance. But when I pick up the car, the rental agency will?

We Answered:

How about renting a car the old-fashioned way and calling them? That way, when you pick up the rental, you can purchase or decline the rental in person.

Who does an insurance "agent" represent?

We Answered:

Most insurance companies do not sell insurance directly to the public since they do not have the want or capacity to service the clients directly

So usually the agent representing the company builds the relationship with the client.

They are paid a commision on the premium written, and that is how they are paid.

At least in my state, when it comes down to claims, the company is the last word, although agents are representatives of the company we have no authority to deny or accept claims as covered without a specialized representative from the carrier. The agent is ultimately responsible for the selling and the services of the policy, the company wants to make sure that the agent isn't trying to cover the claims that have not been accepted by the company.

Although I have made several calls on behalf of my clients to the companys regarding their claim it mostly lies in the adjusters hands when it comes to claims.

I know this will probably just fustrate you more but this is how it works...at least here in NM

Can my employer require me to use my insurance to cover OSHA mandated medical exams?

We Answered:

I am an OSHA officer and to my knowledge, it has to be covered by your employer as your job creates the risk for exposure. But, if you like your job, it may not be worth ruffling feathers since they are offering to pay your co-pay. Most clinics do the PPD for only $20. That's the cost that 6 clinics I worked at charge. Then there is always the free route thru your local health dept.

Floyd Said:

i had an agreement with a collection agency, now they are suing me?

We Answered:

They can certainly try. Married couples can be found liable for each others debts. What does your divorce decree say? Does it specifically mention this debt or include this debt within others named?
The fact that you have been making payments assumes you have admitted or taken responsibility for the debt. That could work against you.
It is a common, false belief that as long as a person makes payments, regardless of how small, that they cannot be sent to collection agency or sued. Unless the amount of the re-payment is agreed upon by both parties, it does not have to be accepted.
Collection agencies use many scare tactics to get larger lump sum final payments. They very well may take you to court. You may get a judgment against you for larger payments or any other decision the judge decides. May go in your favor, may not.
