You're both right. The problem is most of the cut-offs for requirements for offering coverage doesn't apply to companies with fewer than 50 employees. So, if the economy improves they won't hire temps, but they will hire sub contractors. It's illegal for someone to receive all of their pay from just one company and still label them as contractors SO companies will create separate entities to pay the contractors from two entities and still not have to offer them benefits. That's what FedEx does. Their drivers are 'self-employed,' but since FedEx is technically their employer they get paid by two different subsidiaries so they can circumvent the law. That's my generic understanding of how it works anyway. It technically might work different.

Regardless, the new law made it more difficult to hire new employees in some cases for sure.

Sorry but it's not likely. Your best bet would be to find a Filipino company that also has offices in Australia or a multinational company with offices in Aust. that will hire you in the Philipines and allow you to transfer to Australia. It's extremely difficult to immigrate to Australia for any nationality. Do you know of any Filipino businesses in Australia? Perhaps email them your resume.
