Contractors Insurance Agency

Johnny Said:

Can you claim itemized deductions when all of your work was as an agency employee?

We Answered:

You are allowed to itemize deductions. You will use Schedule A of the 1040. If you paid health insurance out of pocket, that is a deductible expense.

Do you have temporary assignments that are estimated to last less than a year? Do you maintain a regular home (i.e. you are not a transient)? If so you can deduct your transportation expenses if you itemize your deductions. These expenses include vehicle expenses and parking. Can be complicated, you may want some help.

If your work assignment is supposed to last more than one year then you cannot deduct transportation expenses.

Health Insurance coverage for Pre-existing conditions?

We Answered:

It will depend upon what state he lives in because of differing state regulations, but in most states companies either will not accept him or will decline. Some companies in some states will accept and cover the condition in some circumstances with an increased premium.

He'll need to contact a local agent that works with all of the major companies in his area. The agent can help him find which companies will accept him and on what terms. There is no extra charge using an agent.

Contractor Insurance in Texas??

We Answered:

The contractor that you hire should be insured and bonded. Its not your responsibility to provide that. Any reputable contractor will be I & B.

Samantha Said:

My nanny agency needs liability insurance, which one should we get?

We Answered:

Sure, but if a nanny you refer causes a problem YOU are going to be sued for it.

You need to contact a large, local independent agency to quote this out. It's likely NOT going to be particularly cheap, ESPECIALLY if you're looking for abuse/molestation defense costs.

If you have an "independent contractor" working exclusively for you, they MIGHT be technically considered an employee for Workers Comp purposes. Even if they aren't, you're still responsible (as the general contractor) for any benefits or claims they might submit, in many states. So you ALSO very likely have a workers comp exposure - which is MORE likely to cause you a financial loss, than the liability.

Sara Said:

Is liability insurance necessary for a mechanical design engineer working as a contractor without an agency?

We Answered:

If he hires you as an employee he assumes the responsibility. If it a a public safety issue then most states require a PE sign off on the work, but insurance is good, I doubt you get it without a PE, you may by a bond for the particular job, but no guarantees.
