How the medical bills are filed, depends WILDLY on what state you are in.

For example, in PA, regardless of who's car you are in, you collect under your OWN policy's benefits. If you have no policy, you collect under your mother and father's policies. If neither of them have policies, you collect under any OTHER policy owned by any OTHER resident of your household.

Regardless of which state you are in, if your girlfriend was driving, you can ALWAYS sue her, for your bodily injuries, and THEN they'll end up paying them - plus pain & suffering.

But if YOU were driving, then you caused your OWN injuries, and you can't sue yourself - you'll have to pay for your own injuries yourself.

It is quite possibly true, in quite a few states, that the insurance of the car you are in, won't pay your medical payments - ESPECIALLY IF you are not a listed driver on the policy, and you were driving.

Well, they do actually work across state lines... (AIG does business in every state!), however... I agree with the spirit of your question. This is a GROSS misuse of the commerce clause...

It has never been done in the history of the country to regulate a product and then force the citizens to buy THEIR version of the product!

... Once you have your policy in force from Progressive (or anywhere else) call or go to Commerce insurance and cancel you policy and ask for a refund of your unused premium.
