Chuck T is wrong. Child Seats (and seat belts) are only designed to withstand one impact. Just because you can't see a crack, doesn't mean that the seat's structure is still intact.

Its replacement ought to be covered by the third party's insurance.

The police won't help you collect. About all you can do is sue her. Small Claims Court can be pretty cheap and easy.
But... you have to be able to have her served, so you need to know where she lives or works. Then she has to have money or wages that you can have garnished. If she doesn't have assets or a good job, it may be near impossible to get any money from her.

First of all, police do not determine fault.

It's not up to the INSURANCE company, to make sure you are in compliance with the requirements of your LOAN. It's up to the LENDER.

Also, you should be receiving a copy of your policy, every renewal period.

If your agent never gave you full coverage, which, btw, doesn't mean you are fully covered, then you have to go back to your paperwork when you bought the car, and see if he gave you a BINDER of coverage. If he did, then his errors and ommissions coverage is on the hook for this.

American Family, however, is NOT. He CANNOT give you coverage without your permission. He might have mentioned it, and probably should have followed up - but you've definately received at LEAST one renewal policy since then. You should have looked at what you were paying for.

So, you can TRY to hire a lawyer and sue the guy for errors and ommissions. You can't claim, you have to SUE. And it's probably going to cost you more than your damages.

Your LENDER should have noticed, though, that you didn't have the coverage required by the loan.

If they DO pay for this, it's highly possible that your deductible will apply, AND you'll get a surcharge on your policy.

Fault for an accident does not matter. Unfortunately it will still show up as an accident on your record however so be sure to tell any insurance company about the accident.

The accident won't leave an "IMPACT" but it may have an "EFFECT" .

There is no such place as "the cheapest place to get car insurance". What is best for one, may not be best for another. There are way too many variables. Simply call around for quotes.
