Products Liability Insurance

Jeffrey Said:

I need to get product liability insurance for my products/company.?

We Answered:

You need to talk to local, independent agents, who can put this out to market. You can't go directly to a company - they won't deal with you. You need a broker, who will find an excess carrier, who MIGHT be willing to do this.

It's going to be expensive.

Find a local, independent agent through www.iiaa.org

How important is product liability insurance for people who sell handmade bath/body items?

We Answered:

Contact an attorney to see if liability insurance is recommended or could he/she write a disclaimer that could be included with the product.

I am starting an eBay business selling goods manufactured by others. Do I need products liability insurance?

We Answered:

If you have not set up a corporation or an LLC you do have a risk of loss that could jeopardize your personal assets. If a lawsuit is brought against you and the judgment goes against you would have to personally pay the plaintiff. Even if you are completely without fault how much will it cost to defend the lawsuit?

The risk is even greater if the goods you resell are from a foreign source because you are here in the United States and much easier to sue than a foreign manufacturer.

Bottom line, If you are serious, contact an attorney to set up a corporation that will limit your financial risk to the assets of the corporation. Second, call an independent insurance agent that writes commercial insurance policies.

Best wishes for your business success.

I need to find product liability insurance for bath & body products. This is a home based business.?

We Answered:

The Companies do not always want the products liability. I just insured a pharmacuetical maker, and had to write the products liability on a separate non-admitted carrier paper policy (kinda like Lloyds)

Ask around. And the person that answered that was a homeonwer specialist is correct. Your current carrier could deny coverage, check into it.

What are good companies for Product Liability Insurance?

We Answered:

EVERY property/casualty insurer, offers SOME form of product liability coverage.

Now, will they offer liabiltiy coverage for YOUR product? No idea - it depends on the product. But I CAN tell you, if you don't have three years of prior coverage loss runs, you're not going to get a quote out of State Farm - or any other "standard" carrier. You'll need to get your insurance on the excess market, from an independent agent - you won't be able to buy it DIRECTLY from anyone.

If i want to sell glass art products through a gallery in the UK, do i need public liability insurance?

We Answered:

Some galleries may cover your products, some may not. Before entrusting your products to the gallery you need to clarify what happens in the case of breakage in transit, breakage when in the gallery's care, commission on sales and what happens in case a customer returns an article, how long the gallery will keep your products and are you liable for collection of unsold items.

These things should all be agreed in writing.

The short answer is, speak to the gallery. If they are not sure, then be wary of dealing with them and take out your own insurance!

For those who import products from factories in China, who carries the Product Liability Insurance?

We Answered:

You BOTH carry the product liability coverage, but the product liability doesn't cover manufacturing defects. Otherwise, you'd have no incentive to do the job right.

If the actual manufacturer doesn't carry product liability coverage, you'll have a bear of a time buying product liability coverage to cover your product here in the states. ESPECIALLY because of the tendency for China's manufacturers to play fast and loose with the product specs.
