If the driver was in the course and scope of his employment and had permission to use the vehicle, the commercial property owner's insurance company would provide coverage to the driver. He would be considered an "insured" by definition under the commercial auto policy. The driver's personal auto would likely deny coverage if he was working at the time of the accident, but that would be subject to interpretation of his personal auto policy.

Call the commercial property's insurer and file a claim. They will complete an investigation and let you know if they accept liability.

Are you doing "for sell by owner"?

If so - get in contact with a company that does commercial real estate and get the building listed with a realtor.

The biggest problem you will have is there are not many people starting businesses and looking for commercial buildings right now.

You have it leased - would your current tenant be interested in purchasing the building? You could do an lease/purchase. You could also talk to your bank about a short sale.

At this point - you are not trying to make money on this building or even break even. This is a "forget the cheese - get me out of this trap" situation.

Who would you approach to sell the building? Businesses that could use a building like yours.
So you need to increase your business contacts. Join the Chamber of Commerce in you area or any other club or organization where business people are located.

Are there other businesses in your area that may be interested in your building? If so, invite them to an open house. Go in an actually speak with the owners of those businesses- not a fax blast or email. Even if they are not interested - invite them to come and see if they know anyone that may be looking for a building like yours.

You want to develop relationships and get the word out in your local business community that you have a building for sell.
