Commercial Auto Insurance

Robin Said:

Can I write off standard miles and commercial auto insurance as a 1099. My employer made me get commercial ins?

We Answered:

You are not allowed to deduct both standard mileage and insurance for the same vehicle. If you deduct any expense, except parking and tolls, for a vehicle, then you are not allowed to deduct the standard mileage rate for that vehicle. If you deduct the standard mileage rate for a vehicle, then you are not allowed to deduct any other expense, except parking and tolls, for that vehicle.

If you deduct actual expenses for the vehicle (gas, oil, registration, repairs, etc.), then you can include the insurance, but cannot deduct the standard mileage rate for the same vehicle.

Donald Said:

are employers required to inform independent contractors about commercial auto insurance?

We Answered:

Correct. There is an absolute exclusion in every personal auto policy, if you're using your vehicle, to make deliveries for work. This is most commonly seen with pizza delivery related accidents.

If you're an independent contractor, then you're responsible to have all your own insurance. You'd get paid without taxes being withheld from your check.

Even if you're an employee, you're still responsible for YOUR insurance on YOUR car, your employer isn't responsible.

It's not up to your employer to make sure you read your policy to know what's covered. It's up to YOU.

The REASON pizza joints hire other people to deliver pizzas, is because delivery insurance is REALLY expensive, and they'd like to foist that cost off on someone else. Sorry.

Eduardo Said:

when is it necessary for a small business to have commercial auto insurance?

We Answered:

Because you're a business and not an individual - which means that your potential liability is much greater. It's the same as your homeowners insurance - if you run your business out of your home and don't have commercial insurance and your house burns down, no part of your commercial busines will be reimbursed.
