Yes, you and your business are the same legal entity. You can have as many trade names as you wish, but you are still you. The only way you'd be considered a different legal entity than your business is if your business becomes incorporated. Even then, as director, you are still responsible for GST and Payroll, and can be personally assessed.

You have three choices

In both cases You will need to get an FBI police security check from FBI HQ in Virginia. You may also need to get police checks from every state and country you have lived in since the age of 18. Definitely get the international ones. The state ones - sometimes CIC asks for them, and sometimes not - so its best to wait until you are asked.

1 - federal skilled worker

You need to have at least 1 years work experience in your chosen field before you can apply. 4 years is better - gives you more points.

You must meet the following minimum requirements to apply as a skilled worker:

You must have at least one continuous year of full-time, paid work experience or the equivalent in part-time [1 year full time - 2 years part time]. continuous employment. Your work experience must be Skill Type 0 (managerial occupations) or Skill Level A (professional occupations) or B (technical occupations and skilled trades) on the Canadian National Occupational Classification (NOC).
You must have had this experience within the last 10 years.

If you have work experience and skills for any of the following occupations, then your applicaiton will be fasttracked and processed faster than other applicants.

You will need at least $10,000 saved up - more if you have family - before you apply as you will be required to show this proof that you have this money when you apply.

Currently taking 2 years from USA. And then after you are admitted to Canada, you MUST live in Canada for 3 years before you can apply to be a citizen. That is currently taking about 12 months to be processed, so altogether it takes you 6 years to legally become a Canadian citizen.

2 - provincial nominee.

If you speak french then you can apply for Quebec,. IF you do NOT speak french, then apply for another province (Ontario, BC or Alberta are the best) .

Quebec selected skilled worker.

If you do emigrate under the provincial nominee program, you are required to stay in that province for (either) 2 or 3 years before you can leave. You must fulfill all other requirements as stated above.

Provincial nominee programs can be processed faster than the federal program.


3 - Business experience

If you work on a work permit in Canada for 2 years (24 full months) on FULL time hours the entire time (this means 37.5 hours minimum per week) then once the 2 years has passed, you can apply for PR from inside Canada, while you continue to work those hours and that job.

What type of business are you in? In B.C. the only required liability insurance written into law to be carried is for vehicles and, subjetc to certain conditions, new home warranty. In B.C. the minimum liability limit that has to be carried for vehicles is $1,000,000 for buses, taxis, limos, commercial vehicles over 5,000 Kg gross vehicle weight and commercial trailers. All other vehicles the minimum limit is $200,000, except for vehicles carrying dangerous goods which must carry $2,000,000.
As for Commercial General Liability, while there are no written laws saying a business must carry liability insurance, there are plenty of regulations, both governmental and private, that state a business must produce evidence of liability insurance before you can conduct business. Some will even state the minimum limit you must carry. For example if you are a tour operator and you wish to do tours into the Pacific Rim National Park, Parks Canada regulations state all tour operators must carry $2,000,000 Commercial General Liability coverage, and produce evidence of such, before they will be given permission to do so. So you will have to confirm this with your clients/prospects before going out and getting quotes for liability insurance to get an idea of what limit you should ask for. BTW the minimum liability limit any insurer in B.C. will do is $1,000,000.

Yes, Canada has a national insurance program, but you have to be there legally to use it, and you have to have an address, and be "in their system". You can't just hop the border, show up, and expect to be treated, like you can in the US.
