You have been given a lot of really bad, bad answers here. First of all, no one, not even an insurer, is obligated to pay you more than a car is actually worth. I don't care if you've spent $50K keeping it running, a 1999 Dodge Neon isn't worth squat. If you were shopping for a car, which you probably will be soon, are you going to pay 60% more than book value for an average car just because the owner has spent a lot on repairs and upkeep? If you would, then you need help. Second, no lawyer will touch this. Even if you could find one that was desperate or crazy enough he/she/it will charge you more than your settlement to handle it for you, not to mention that insurance companies have dozens of lawyers on staff to squash miserable issues like this. No one is avoiding responsibility just because they aren't offering what you want. Make sure the value of your car is correct, (check for cars for sale in your area and NADA price guide). If they're truly not offering you what the value is then prove it -- they will pay it. If not, then welcome to the real world.
